1. Overview

These Terms of Use (“Terms”) govern your access to and use of the Vignette website, app, products, and services (collectively, the “Service”). The Service is operated by Big Picture Creative, a sole proprietorship owned by Stephanie Bignell in Ontario, Canada. In these Terms, “Vignette,” “we,” or “us” refer to Big Picture Creative when operating the Service. By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least the age of majority in your jurisdiction to use the Service, or have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet this requirement and that any information you provide is accurate and complete.

3. Accounts

Some features of the Service may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us promptly if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being misused.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload, share, or create content that is hateful, harassing, defamatory, violent, explicit, or otherwise harmful.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Reverse engineer, decompile, or otherwise attempt to obtain the source code of the Service.
  • Use automated tools (scrapers, bots) to extract data or content from the Service.
  • Create a competing product or service using access to the Service or its underlying assets.

5. Intellectual Property

Vignette, the Vignette logo, branding, interface design, original photography, and all related content are owned or licensed by Vignette and are protected by intellectual property laws.

Your use of the Service does not grant you any ownership in our intellectual property. Rights to use scenes, mockups, and exported images are governed by our separate Terms & Usage (license) document, which explains how you may use Vignette scenes, exports, and related assets.

6. User Content

You may upload logos, designs, images, or other content into the Service (“User Content”). You retain ownership of your User Content.

By uploading User Content, you represent and warrant that:

  • You own or have all necessary rights to your User Content.
  • Your User Content does not infringe any third-party rights.
  • Your User Content complies with these Terms and applicable law.

You grant Vignette a limited license to store, process, and display your User Content solely for the purpose of operating and improving the Service. Additional rights related to showcasing exports, if applicable, are described in the Terms & Usage document.

7. Scenes, Mockups & Licensing

Use of scenes, mockups, background images, and exported files from the Service is governed by our Vignette – Terms & Usage (license) page. That license explains what is permitted (for example: using exports in your client work) and what is prohibited (for example: reselling scenes, creating mockup templates).

In the event of any inconsistency between these Terms of Use and the Terms & Usage license with respect to asset usage, the Terms & Usage license will control for asset-related questions.

8. Payments, Subscriptions & Trials

If you subscribe to a paid plan, you agree to provide accurate billing information and authorize us or our payment processor to charge applicable fees.

Subscription details, including pricing, billing frequency, free trials, and cancellation terms, will be displayed at the point of purchase or in your account settings. Unless otherwise stated:

  • Subscriptions renew automatically until cancelled.
  • Cancellation stops future billing, but does not retroactively refund past periods.
  • Access to premium features and scenes ends when your subscription expires or is cancelled.

9. Third-Party Services & Links

The Service may include links to third-party websites or services (such as image providers, payment processors, or external resources). We do not control and are not responsible for the content or practices of third parties.

Your use of third-party services is governed by their own terms and policies.

10. Privacy

Our handling of personal data is described in our Privacy Policy, which will be made available on our website. By using the Service, you consent to our collection and use of information as described there.

11. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, misused the Service, or engaged in harmful behavior.

You may stop using the Service at any time. Termination does not relieve you of any outstanding payment obligations.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, Vignette and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless Vignette, its owners, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your infringement of any third-party rights.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective date” at the top of this page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Ontario, Canada.
